I honestly think that saying less is better for you under these circumstances. Anticipating more sophisticated arguments and making them implicitly for them will not necessarily help you. Even after all of the posts here, I still wouldn’t say anything more than the points I outlined in a much earlier post in this same thread.

Understand, however I want PCNA to know what I intend to do. Everything is spelled out in brief so they don’t even need to read my posts. They need time to consider the risks. There is no risk /reward outcome or PCNA only risk. The salient points will be made during the hearing. BTW I intend to share the entire brief at some point in the forum. Also, this is not a pure legal matter it is also a PR matter related to PCNA and the car. I already have lined up a reporter to attend the hearing if it ever happens. Hopefully the arbitrator will make the hearing public vs private. I do appreciate all the advice and suggestions.. FYI i have been involved in hundreds of arbitration's over 40 years, mostly labor relations, However, I have done 2 cases previously against BMW and prevailed against their highly paid legal teams. Lesson here is never piss off a retired senior citizen who has the time to pursue issues that matter !

are you expanding the "brief" to include VW/Audi? the same EVSE with the same thermal issues is distributed with vehicles across the entire VW/Audi/Porsche/Bentley/Lamborgini?? line - this design is unmodified across the entire VW empire…

No. Only focusing on Taycan since as a owner I have legal standing only to matters that pertain to Taycan.. BTW your previous posts have been most helpful and insightful in developing the brief

Ok, but one last point: the bigger and more public you go with this, the harder it will be for Porsche to just settle yours. It creates more incentives for them to fight. Ok, so it’s up to you to decide what your real goals are, but if you were focused solely on your situation, narrow, targeted and non-public is the key to success.

No. Only focusing on Taycan since as a owner I have legal standing only to matters that pertain to Taycan..

I take that as if you charge at 100% from your house, you should stop because it can cause fire. Read the manual for a written warning.

yes i had to downtune the charging current on my Porsche charger from 38 Amps to 30 Amps t0 prevent premature shutting down during the charging process.
Update re Arbitration: Warning do not attempt to file an arbitration claim unless you meet the following criteria: 1. Must be retired in order to have the time and be over 70 yrs in age. 2. Wife must agree not to yell at you for spending so much time preparing 3. Prepare for misleading, contrary information from all parties involved- another words read everything and do not trust what you read in PCNA manuals etc
A. Filed brief along with massive amount of required documents required by the CAP-Motors requirements. B. The process is Arbitration not mediation, however, PCNA ‘s independent firm that handles the filing wrote me a letter that this is mediation . I sent them back their own documented rules that says it is arbitration and they responded “disregard their letter”. Lol you have to appreciate how confused and misinformed PCNA and the firms they hire to administer this program must be.
Just received email that the arbitration has been approved to move forward and a case # assigned.

interesting - gotta love it - I'm also thinking they are in over their heads regarding _ANY_ EV or related issues -they are going to be very very confused.

in the mean time @AndiL (whom I trust 100%) has noted the 3014 software update (that caused this whole mess) has been pulled world wide - it is no longer available - now we'll have to see how Porsche addresses two thing:
  1. restoration of pre-3014 behavior?
  2. any physical change to the charger (new cord) to address the overheating issue

interesting - gotta love it - I'm also thinking they are in over their heads regarding _ANY_ EV or related issues -they are going to be very very confused.

in the mean time @AndiL (whom I trust 100%) has noted the 3014 software update (that caused this whole mess) has been pulled world wide - it is no longer available - now we'll have to see how Porsche addresses two thing:

Don’t insult Marlin! They are actually pretty smart. I spend a fair amount of time in the Republic of Panamá and have really come to respect them. They hunt in packs and get bait fish into these giant balls. If you tried to swim into it, you would never get a single fish, which is the defense. So they take turns swimming into the ball and using their swords/noses as baseball bats so they knock fish out of the ball one or two at a time where they are defenseless and quickly eaten by the marlin swimming around the outside. Then they trade places. They will also run away from you so quickly once hooked that they will strip your reel, or run towards you so fast you can’t reel in quickly enough, unless you have a good enough capitán to deploy the boat in your favor. We have even had them leap into the back of the yacht as if to attack the fishermen. So, I’m not sure your relative estimation of intelligence is accurate or fair. ;)
